If proven, that is quite a problem for MyM...

If proven that's quite a problem for NEO too.....Failure to protect customer information is taken very seriously e.g. Orange got a massive slap on the wrist when some of their employees were found stealing data.

Depending on the exact circumstances of the breach, and whether they deem NEO could/should have done more to protect the data, he may not only have doomed MyM with his actions but could drag down NEO with him.

I am not sure how NEO could have prevented it? The "thief" was the person at NEO responsible for the data, and the server it was stored on. As they are a relatively small organisation, they wouldn't have the means to police those who are managing the data?

Like I said: Depends on the exact circumstances. All I was saying is that if NEO aren't seen have complied with the DPA, to the letter (and it's a complicated beast - very easy to fall foul of unintentionally), then they could be in just as much strife.

I'm glad NEO have taken legal advice. They need to do so as a matter of urgency because both they and MyM are in a lot of potential trouble.

To state that they have no ability to lock out a former director from a list he has control over is a very weak defence. As soon as it was clear he was going, they should have encrypted the data (it obviously wasn't at the time) and locked him out of the system. from what I can gather this dismissal was not structured, so NEO have left themselves very vulnerable.

Given what I know from my dealings with the Director of MyM, it's entirely in his nature to do something malicious. They should have taken account of this.

Sadly, in common with most small companies, they probably just aren't particularly organised with their data.

What we now want to know is what steps have been taken by Uncooked Media to ensure that this cannot happen again in future.
